New Colorado Law Bans Holding A Phone While Driving
In 2023, Colorado law prohibited drivers from using a cell phone while driving unless they operate the phone with a hands-free device. In 2025, the state is going a step further by making it illegal to hold a mobile device while you drive.

What's Different About Colorado's Hands-Free Law?
Starting in 2025, all mobile devices being used by a person operating a vehicle must be used 'hands-free." Did you catch that? All mobile devices. Not only is it illegal to talk on a phone without a hands-free device, but the Colorado Hands-Free Law says it will soon be illegal to drive and operate any mobile device without using a hands-free option.
2024 Driver Behavior and Exemptions
KKCO reports data from CDOT's 2024 Driver Behavior Report says two-thirds of Colorado drivers admitted to using their phone while driving. 45% of those surveyed said having a hands-free option in their car would stop them from using their phone.
The only time drivers would be allowed to use a mobile device while operating a vehicle would be to report an emergency.

Colorado's Fine for Driving and Holding A Phone
Anyone holding and using a mobile device while driving will be subject to a $75 fine and two license suspension points for their first offense. Find out more about the new mobile device ban for Colorado drivers here.
